Article 2 – Products
The Website offers heated knee massage devices and related accessories for sale. The essential characteristics of the products are presented on each product page. Photographs are for illustrative purposes only and are not contractually binding.
Article 3 – Prices
Prices are stated in euros (€), inclusive of all taxes. As the micro-enterprise benefits from the VAT exemption scheme, the statement “VAT not applicable, Article 293 B of the French General Tax Code” applies where relevant.
BOTEA reserves the right to change its prices at any time. However, the price displayed on the date of the order is the only price applicable to the customer.
Article 4 – Orders
The customer selects the products, adds them to their cart, then confirms their order after checking the details and total price. Order confirmation constitutes acceptance of these Terms and Conditions of Sale. An order summary email is sent to the customer after confirmation.
Article 5 – Payment
Payment is made online by bank card through a secure payment platform. The order is considered final once payment has been confirmed.
Article 6 – Delivery
Products are dispatched to the address provided by the customer when placing the order. Unless otherwise stated on the product page, BOTEA undertakes to deliver the product within a maximum of 30 days of order confirmation, in accordance with Article L216-1 of the French Consumer Code. This statutory maximum period will be replaced with a specific timeframe (e.g. “X to Y business days”) as soon as it is known.
If delivery is delayed by more than 30 days, the customer may request cancellation of the order and a refund of the amounts paid, in accordance with Article L216-2 of the French Consumer Code.
Article 7 – Right of withdrawal
Under Articles L221-18 et seq. of the French Consumer Code, the customer has 14 full days from receipt of the product to exercise their right of withdrawal, without giving a reason or incurring a penalty.
To exercise this right, the customer must notify us of their decision by email at contact@boteacare.com before the period expires, then return the product in its original condition. Return shipping costs are the customer’s responsibility, unless otherwise stated on the Website.
A refund will be issued within a maximum of 14 days of receipt of the returned product.
Article 8 – Statutory guarantees
Every product sold on the Website benefits from:
- The statutory guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code), for two years from delivery;
- The warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
These guarantees allow the customer to obtain repair, replacement or a refund for a faulty product, free of charge.
Article 9 – Liability
BOTEA cannot be held liable for damage resulting from improper use of the product that does not comply with its instructions for use. The devices sold are not a substitute for medical advice or treatment.
Article 10 – Personal data
Data collected when an order is placed is used exclusively to process the order and manage customer relations, in accordance with the GDPR. Customers have the right to access, rectify and delete their data by contacting contact@boteacare.com.
Article 11 – Customer service and complaints
For any questions or complaints, customers may contact customer service at contact@boteacare.com. If a dispute remains unresolved, the customer may use a consumer mediation service free of charge.
Article 12 – Governing law and disputes
These Terms and Conditions of Sale are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal proceedings are initiated. Failing this, the matter will be referred to the competent French courts.
